PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT") CAREFULLY BEFORE ACCESSING OR USING THE FORME MOBILE APPLICATION AND ANY ASSOCIATED SERVICES (COLLECTIVELY, THE "SERVICE"). BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT IN ITS ENTIRETY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICE.
THE SERVICE IS INTENDED SOLELY FOR INDIVIDUALS WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER. By accessing or using the Service, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding agreement. Any access or use of the Service by any person under the age of eighteen (18) is expressly prohibited and constitutes a material breach of this Agreement. Forme reserves the right, in its sole and absolute discretion, to terminate access and pursue all available legal remedies upon discovery of any such violation.
THE SERVICE IS PROVIDED SOLELY FOR GENERAL WELLNESS, INFORMATIONAL, AND SELF-IMPROVEMENT PURPOSES AND DOES NOT CONSTITUTE, AND SHALL NOT BE CONSTRUED AS CONSTITUTING, MEDICAL ADVICE, CLINICAL TREATMENT, PSYCHOLOGICAL COUNSELING, PSYCHIATRIC CARE, DIAGNOSIS, PROGNOSIS, OR ANY OTHER LICENSED PROFESSIONAL SERVICE. No provider-patient, therapist-client, or fiduciary relationship is formed by your use of the Service. Nothing communicated through the Service, whether by automated means or otherwise, should be relied upon as a substitute for consultation with a duly licensed and qualified healthcare, mental health, or medical professional. You acknowledge and agree that your use of the Service is at your sole risk and that Forme disclaims any and all liability arising from your reliance on content generated or delivered through the Service.
Access to certain features of the Service requires payment of applicable fees pursuant to the subscription plan selected by you at the time of enrollment ("Subscription"). All Subscription fees are processed exclusively through Apple Inc.'s App Store payment infrastructure and are subject to Apple's applicable terms and policies. Monthly Subscriptions automatically renew at the conclusion of each billing period unless cancelled by you no later than twenty-four (24) hours prior to the end of the then-current period through your Apple ID account settings. The Lifetime Access option constitutes a single, non-recurring, non-refundable one-time payment. All fees are denominated in United States dollars unless otherwise specified. Forme reserves the right to modify Subscription pricing upon reasonable notice. All sales are final except to the extent required by applicable law.
The Service and all content, features, functionality, software, interfaces, designs, text, graphics, imagery, data compilations, algorithms, coaching methodologies, and other materials made available through the Service (collectively, "Proprietary Content") are and shall remain the exclusive intellectual property of Forme and its licensors, and are protected by applicable copyright, trademark, trade secret, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial purposes. You shall not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, reverse-engineer, decompile, disassemble, or otherwise exploit any Proprietary Content without the prior express written consent of Forme.
You agree that you shall not: (i) use the Service for any unlawful, fraudulent, or unauthorized purpose; (ii) attempt to gain unauthorized access to any portion of the Service or its related systems; (iii) interfere with or disrupt the integrity, performance, or security of the Service; (iv) use automated scripts, bots, or other means to access, scrape, or extract data from the Service; (v) transmit any content that is defamatory, harassing, threatening, obscene, or otherwise objectionable; or (vi) use the Service in any manner that could damage, disable, overburden, or impair Forme's infrastructure.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. FORME HEREBY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FORME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, NOR DOES FORME WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT DELIVERED THROUGH THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORME, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT FORME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Forme and its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use of or access to the Service; (ii) your violation of this Agreement; (iii) your violation of any applicable law or regulation; or (iv) any content submitted by you through the Service.
Forme reserves the right, in its sole discretion, to modify, amend, or replace any provision of this Agreement at any time. Modified terms shall be effective upon posting within the Service or upon such other notice as Forme may provide. Your continued use of the Service following the effective date of any modification shall constitute your acceptance of the revised Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles. Any dispute arising under or in connection with this Agreement shall be resolved through binding arbitration in accordance with applicable arbitration rules, and you hereby waive any right to a jury trial or to participate in a class action proceeding.
